Consumer Class Action | Complaint Filed
Did you buy Nestlé Drumstick cones believing they were ice cream?
Josef Timlichman Law, PLLC has filed a proposed class action in the United States District Court for the Southern District of Florida on behalf of consumers who purchased Drumstick cones. The lawsuit alleges that the product was reformulated years ago so that it no longer meets the federal definition of ice cream, that it is labeled "frozen dairy dessert" in small print, and that it is nonetheless marketed and sold as ice cream through the website icecream.com, retailer listings, the ice cream aisle, and branded freezers. These are allegations, not findings of wrongdoing. No court has decided whether the allegations are true, and no class has been certified.

Proposed class action filed
A proposed class action was filed in the United States District Court for the Southern District of Florida. The complaint is available below. Its allegations have not been decided by a court, and no class has been certified.
What the lawsuit says
The complaint alleges that:
- Drumstick was sold as ice cream for decades, beginning in 1928.
- By 2009 the recipe was changed. Milkfat was replaced with vegetable oils such as coconut and palm oil, and the product no longer met the federal standard for ice cream (21 C.F.R. 135.110).
- The box now says "frozen dairy dessert" in small type, but the product is still presented as ice cream on icecream.com, in retailer listings, in the ice cream aisle, and in branded freezers.
- Consumers paid an ice cream price for a product that is not ice cream.
These are allegations, not findings of wrongdoing. No class has been certified.
