Florida Injury and Insurance Deadlines: What to Check

By Josef Timlichman, Attorney

Short answer

There is no single deadline for every Florida injury or insurance claim. Identify the claim, relevant dates, parties, policy and any required notices, then obtain individual review promptly. Reporting an incident or opening an insurance claim does not necessarily preserve a lawsuit.

Which deadlines should I check first?

Filing a lawsuit, notifying an insurer and satisfying a benefit or pre-suit requirement are different tasks. Meeting one deadline does not establish that all others have been met. Chapter 95 addresses limitations and accrual; other statutes and contracts can add separate questions.

  • 1. Record the incident, loss, treatment and discovery dates, marking estimates clearly.
  • 2. Identify every potentially responsible party and the specific claim.
  • 3. Preserve the insurance policy, ticket or contract and all correspondence.
  • 4. Ask an attorney to review filing, notice and procedural requirements together.

Why does the claim type matter in Florida?

Negligence, wrongful death, medical negligence and contract claims may follow different frameworks. Medical negligence may involve Chapter 766 pre-suit procedures. Claims against public bodies can raise additional notice issues. Do not assume a general injury rule answers these questions.

Are insurance notice and lawsuit deadlines the same?

No. Property claim notice is addressed in section 627.70132, while a lawsuit also requires review of the cause of action, policy and applicable law. For auto insurance benefits, section 627.736 contains separate eligibility conditions. Preserve the documents and request advice based on your facts rather than calculating a deadline from this guide.

What if I am still waiting for records or an insurer?

Do not assume that negotiations, a records request, ongoing treatment or a pending insurance decision extends a deadline. Give the attorney the known dates and identify missing information. This guide does not determine whether time remains in your matter.

Frequently asked questions

Does opening an insurance claim stop the time to sue?

Do not assume so. Insurance reporting and lawsuit filing requirements need separate review.

Can this guide calculate my deadline?

No. The claim type, dates, parties, policy, law and possible exceptions require individual legal review.
