Frequently Asked Questions About Florida Real Estate Disputes
How can a commercial real estate broker recover an unpaid commission in Florida?
Start with the brokerage agreement, proof of services and closing records. Florida law provides commission lien procedures for certain commercial sales and leases, but eligibility, notice requirements and deadlines matter. A sales commission lien generally concerns the owner's net proceeds, not ownership of the property itself. It does not automatically freeze every closing. We review whether a contract claim or an applicable lien procedure fits the dispute.
What remedies are available for a breach of a real estate contract?
Depending on the agreement and facts, potential remedies include financial damages, specific performance requiring completion of the transaction, or rights involving the earnest money deposit. These remedies are not automatic or necessarily available together. Default provisions, notice requirements, remedy limitations and applicable law must be reviewed.
What constitutes fraud or civil conspiracy in a real estate transaction?
A fraud claim may involve a material misrepresentation or a failure to disclose where a duty exists, reliance and resulting harm. Civil conspiracy requires more than people working together: the agreement, underlying wrongful conduct and resulting damages matter. A disputed commission or disappointing transaction alone does not establish fraud or conspiracy. We review the agreements, communications and transaction history.
Who pays the attorney's fees in a Florida real estate lawsuit?
Winning a lawsuit does not automatically entitle a party to attorney's fees. A contract provision or applicable statute may authorize recovery, subject to its wording, procedural requirements and the court's decision. Court costs are a separate issue. We review the agreement and possible fee exposure before discussing litigation options.
