Truck black box and ELD data: why it disappears and how to preserve it

By Josef Timlichman, Attorney

Published · Last updated

Short answer

Truck electronic information can be overwritten or changed through continued use, device settings and service activity. Identify the systems and custodians promptly; there is no universal retention period in this guide.

Different devices hold different information

Engine control modules may record vehicle events; ELDs concern driver activity; cameras, GPS and dispatch systems can contain separate records. Not every truck has every system.

Preserve device identity, time-zone settings, native files and associated metadata. A screenshot or summary may not contain the full original record.

Why preservation requires specific requests

An attorney can identify the carrier, vendor and device and request that relevant electronic and physical evidence be retained. Do not access equipment yourself or alter files.
