What a spoliation (preservation) letter is
Published · Last updated
Short answer
A preservation letter identifies potentially relevant evidence and asks its custodian not to delete, overwrite, repair or discard it. It is not a lawsuit and does not itself guarantee evidence will be produced.
Make the evidence request specific
Identify the collision, truck and trailer, electronic systems, camera files, logs and physical components. The appropriate recipients can include a carrier, equipment owner and records vendor.
A request should account for ongoing use, repairs and native electronic files. Preserve copies of the letter and delivery records.
Preservation is not the same as access or a court remedy
Calling or sending a questionnaire does not create representation or confirm that a preservation letter has been issued. The firm must agree to undertake the work.
